Kanu: Court of Appeal Declines FG’s Request For Adjournment

The legal battle between the leader of the Indigenous People Of Biafra (IPOB), Mr. Kanu and the federal government appears to be far from over.

Few weeks ago, the court of appeal discharged Mr. Kanu from the remaining seven count charge preferred against him by the federal government.

Now the court of appeal in Abuja has reversed judgment in an application by the federal government seeking a stay of execution of the court’s judgment that ordered the release of the leader of the Indigenous People of Biafra (IPOB), Mr. Kanu.

Leading the three-man panel, Justice Jummai Hanatu announced that a date for delivering of judgment would be communicated to the parties when ready.

While arguing his motion for stay of execution, counsel for the federal government Mr. David Kaswe told the court that ”Mr. Kanu is a huge threat to national security and must be kept in detention for the relative peace in the south east and the whole country. He added that Mr. Kanu is a flight risk and would escape out of the country if the judgment which ordered his release was not stayed”.

However, the lead counsel to Mr. Kanu, Mike Ozekhome, a senior advocate of Nigeria (SAN) dismissed the claim that Kanu jumped bail in his trial at federal high court. Mr. Ozekhome claimed that military unjustly invaded Kanu’s ancestral home and he escaped death.
